Plaintiffs in Head Start Lawsuit File Motion to Amend Complaint to Challenge New HHS Rule Targeting Immigrant Families
SEATTLE, Wash. 鈥 Today, parent advocacy groups and a coalition of Head Start providers 鈥 plaintiffs in an ongoing lawsuit challenging the Trump administration鈥檚 unlawful attacks on the Head Start program 鈥 announced they have requested to amend their complaint to challenge the U.S. Department of Health and Human Services鈥 (HHS) latest directive, which seeks to exclude many immigrant families from accessing early childhood education by restricting participation in Head Start based on immigration status. Yesterday, HHS issued a directive reinterpreting a nearly 30-year-old law to expand the definition of 鈥渇ederal public benefit鈥 under the 1996 Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) to now include Head Start 鈥 effectively making some immigrant children ineligible for the first time in the program鈥檚 history. The agency provided no implementation guidance to Head Start agencies and declared the policy effective immediately, while also noting that PRWORA鈥檚 verification requirements remain unchanged. The lack of clarity around how the directive will be enforced is creating confusion and fear among providers and families alike. 鈥淚n Chicago, our programs already see families living in fear 鈥 including refugees, undocumented parents, and those here on student visas. Many are paralyzed, unsure if it鈥檚 safe to bring their children to Head Start. This directive adds to that fear, denying children critical educational opportunities and threatening the well-being of entire communities,鈥 said Lauri Frichtl, executive director, Illinois Head Start. In response, plaintiffs are seeking to amend their lawsuit to challenge this unlawful reinterpretation, which contradicts PRWORA and the Head Start Act and threatens to undermine a program that has served over 40 million children and families across the country. "In Alameda County, hundreds of children and thousands of jobs will be affected by this directive. Locally over half of the children from these programs come from immigrant families and the directive will significantly chill participation in our Head Start programs,鈥 said Clarissa Doutherd, executive director of Parent Voices Oakland. 鈥淚mmigrants are threaded through the fabric of our communities and threatening them tears communities apart.鈥 The plaintiffs include parent groups Parent Voices Oakland and Family Forward Oregon, and the Head Start associations of Washington state, Illinois, Pennsylvania, and Wisconsin. Plaintiffs in the case are represented by the 糖心Vlog, the 糖心Vlogof Washington, the 糖心Vlogof Illinois, and the Impact Fund. 鈥淗HS is defying Congress by attempting to impose an immigration-based restriction that neither PRWORA nor the Head Start Act requires or permits,鈥 said Ming-Qi Chu, deputy director of the Women's Rights Project at the ACLU. 鈥淚n the nearly 30 years since Congress enacted PRWORA, Head Start has never been understood as a 鈥榝ederal public benefit.鈥 Reinterpreting PRWORA now to exclude immigrant children is unlawful and a direct attack on some of the very families this program was created to serve. It is clearly inconsistent with the statute鈥檚 text and Congress鈥 purpose.鈥 鈥淣ot only are these exclusions illegal, but the administration has escalated its attack on Head Start, children, and families by declaring that HHS鈥檚 unilateral reinterpretation of a law passed by Congress takes effect immediately. This is a clear attempt to evade the required review process, and we are asking the Court to hold the administration accountable to the rule of law,鈥 said Lori Rifkin, litigation director at the Impact Fund. The administration's staff cuts, delays, and immigration directive threaten the vital early education, health, and social services that more than 800,000 children and families rely on each year. Plaintiffs are urging the court to declare this multi-pronged dismantling of Head Start unlawful and unconstitutional, and to block the administration鈥檚 continued defiance of Congress鈥 mandate to serve low-income families. Parent Advocacy Groups and a Coalition of Head Start Providers File Lawsuit to Stop Trump Administration鈥檚 Dismantling of Head Start
SEATTLE, Wash.鈥 Today, a coalition of parents and Head Start providers filed a lawsuit challenging the Trump administration鈥檚 coordinated and unlawful efforts to dismantle the Head Start program, which would be catastrophic for the millions of people who rely on it. By slashing staff, delaying funding, and imposing bans that block programs from fulfilling their mission to support young children from low-income families, the administration is defying Congress鈥檚 mandate to continue Head Start services nationwide. This multi-pronged attack puts at risk the quality and safe early educational, health, nutritional, and social services that Head Start programs across the country provide to 800,000+ young children and their families every year. 鈥淪ince taking office, the Trump administration has tried to destabilize, paralyze, and sow chaos in Head Start. They have frozen funding, conducted mass layoffs at the federal HHS regional offices, slow walked grants鈥攚hich led to 400 families scrambling to find childcare鈥攁nd now are proposing to eliminate Head Start completely,鈥 said Joel Ryan, executive director, Washington State Head Start & Early Childhood Education and Assistance Program. 鈥淚f we want to preserve Head Start for the children currently being served and uphold its commitment to ensuring that all children are ready for school鈥攔egardless of their background, income, race, ethnicity, or zip code鈥攚e must stand up to the unlawful actions this administration has taken to kneecap Head Start.鈥 Launched in 1965, Head Start was an outgrowth of the Civil Rights Movement and its promise of racial and economic justice, particularly for Black women and children. Since then, Head Start has transformed the lives of more than 40 million children and their families by preparing children for school and supporting working parents with access to childcare. The program provides comprehensive services to low-income families, supporting children鈥檚 emotional, social, health, and educational development. Its federal-to-local model ensures services are tailored to each community鈥檚 needs, including providing culturally and linguistically appropriate services. Agencies are legally required to meet the 鈥渄iverse needs鈥 of their communities, offer inclusive services, and support children with disabilities, dual language learners, and children in foster care or experiencing homelessness. The Trump administration has taken direct steps to halt services by closing half of all Regional Head Start offices and laying off their staff. The administration has also undermined quality and continuity by imposing vague and sweeping bans on activities related to 鈥渄iversity, equity, inclusion, and accessibility鈥濃攁nd threatening severe consequences if Head Start programs fail to correctly guess what these policies prohibit. The DEIA ban allows the Department of Health and Human Services (HHS) to weaponize its monitoring function to enforce 鈥渃ompliance鈥 with ambiguous and undefined terms. Agencies do not understand whether they must cancel current vendor contracts, stop hiring bilingual or culturally competent staff, and abandon outreach efforts that help enroll underserved families in order to comply with the HHS鈥 DEIA ban. Agencies that attempt to comply then risk violating their statutory obligations to meet the diverse needs of the communities they serve and risk losing their federal designation. The ban puts agencies in an untenable position and risks compromising the quality of Head Start services that families receive. The plaintiffs, parent groups Parent Voices Oakland and Family Forward Oregon, and the Head Start associations of Washington state, Illinois, Pennsylvania, and Wisconsin are represented by the 糖心Vlog, the 糖心Vlogof Washington, the 糖心Vlogof Illinois, and the Impact Fund. The lawsuit was filed in the U.S. District Court for the Western District of Washington against HHS, which is responsible for administering Head Start, including distributing federal funds, issuing program guidance, and ensuring grantee compliance with federal law. The complaint alleges that HHS unlawfully implemented the DOGE and anti-DEIA executive orders by gutting the program of staff and resources, delaying access to funds, and issuing vague policies that ban core Head Start programing. These actions have already caused the suspension or termination of Head Start services and will lead to more program closures. Plaintiffs are asking the court to declare the dismantling of Head Start unlawful. We will not stand by and watch HHS upend the lives of the many people that depend on their Head Start providers,鈥 said Jennesa Calvo-Friedman, senior staff attorney at the 糖心VlogWomen鈥檚 Rights Project. 鈥淭he program is a cornerstone in communities across the country, and we are fighting to preserve access to critical education programs and childcare services for all Head Start families.鈥 鈥淗ead Start provides crucial services to communities in every state and region across the country,鈥 said Lori Rifkin, litigation director at the Impact Fund. 鈥淐utting this vital program hurts both children and parents, and directly contradicts the laws passed by Congress.鈥 鈥淎ll parents deserve the opportunity to provide a better life for their children. Head Start gives children and families, including Black, Indigenous, Pacific Islander, Latinx, and immigrant children and families, a fair opportunity to work towards a better life,鈥 said Candice Vickers, executive director, Family Forward Oregon. 鈥淭aking this program away continues cycles of poverty and unfairly targets the children and families it was created to support.鈥 鈥淭hese attacks on Head Start will hit children and families the hardest. With the high costs of childcare, many parents would not be able to keep their families fed and housed without Head Start,鈥 said Clarissa Doutherd, executive director, Parent Voices Oakland. 鈥淒epriving children and families of access to early education and childcare is cruel, and anyone who cares about children should be infuriated.鈥 鈥淭he executive branch cannot defund by fiat a program that Congress has mandated. The reckless cuts authored by the Trump Administration and DOGE block Head Start programs from serving 鈥 and offering a better future to 鈥 low-income children and families across the state,鈥 said Lauri Frichtl, executive director, Illinois Head Start. 鈥淗ead Start is one of the most popular and effective federal programs. It has made a positive difference in the lives of thousands of young people from all backgrounds and communities in Illinois. We are committed to continuing this service for all children.鈥 鈥淗ead Start in Pennsylvania provides vital continuity of care for more than 30,000 children and their families across the state. Families deserve to know that the agencies they rely on鈥攁nd the staff they trust with their young children鈥攁re protected,鈥 said Kara McFalls, executive director, Pennsylvania Head Start. 鈥淓fforts to dismantle Head Start are unacceptable and undermine the strength and well-being of every community.鈥 鈥淚n Wisconsin and across the country, Head Start programs are deeply embedded in the fabric of local communities and their economies,鈥 said Jennie Mauer, executive director, Wisconsin Head Start Association. 鈥淚n Wisconsin alone, more than 300 Head Start centers serve over 15,000 children and families, employing more than 4,000 workers, and the majority of families served are working full time or attending school full time.
